Not only, therefore, is the proposed initiative, on this score, a prohibited revision but it also suffers from being incomplete and insufficient on its very face. For this reason, I concur in the view that Santiago v. Comelec should be re-examined and, after doing so, that the pronouncement therein regarding the insufficiency or inadequacy of the measure to sustain a people’s initiative to amend the Constitution should be reconsidered in favor of allowing the exercise of this sovereign right. Any amendment to, or revision of, this Constitution under Section 1 hereof shall be valid when ratified by a majority of the votes cast in a plebiscite which shall be held not earlier than sixty days nor later than ninety days after the approval of such amendment or revision. The Congress may, by a vote of two-thirds of all its Members, call a constitutional convention, or by a majority vote of all its Members, submit to the electorate the question of calling such a convention.

This is an assurance that every one of the several millions of signatories to the petition had seen the full text of the proposed amendments before signing. Otherwise, it is physically impossible, given the time constraint, to prove that every one of the millions of signatories had seen the full text of the proposed amendments before signing. On 31 August 2006, the COMELEC issued its Resolution denying due course to the Lambino Group’s petition for lack of an enabling law governing initiative petitions to amend the Constitution. The COMELEC invoked this Court’s ruling in Santiago v. Commission on Elections declaring RA 6735 inadequate to implement the initiative clause on proposals to amend the Constitution.

FUENTEBELLA, THE SENATE OF THE PHILIPPINES, THROUGH ITS PRESIDENT, SENATE

X x x x the amending process of the Constitution could actually avert a revolution by providing a safety valve in bringing about changes in the Constitution through pacific means. This, in effect, operationalizes what political law authors call the “prescription of sovereignty.” We agree to the difficulty in implementing this particular provision, but we are providing a channel for the expression of the sovereign will of the people through this initiative system. Corollarily, a constitution is not criminals to be interpreted on narrow or technical principles, but liberally and on broad general lines, to accomplish the object of its establishment and carry out the great principles of government – not to defeat them. So, the Committee finally came up with the proposal that these two terms should be employed in the formulation of the Article governing amendments or revisions to the new Constitution. It was not our intention to allow a revision of the Constitution by initiative but merely by amendments.

These outstanding loans shall continue to earn interest, at the rates stipulated in the corresponding PNs, from 5 September 1979 until payment thereof. The pledge right herewith constituted shall secure all claims which the Bank now has or in the future acquires against Citibank, N.A., Manila , regardless of the legal cause or the transaction which gives rise thereto, and including principal, all contractual and penalty interest, commissions, charges, and costs. On the evidentiary value of these documents, it should be recalled that the notarization of a private document converts it into a public one and renders it admissible in court without further proof of its authenticity (Joson vs. Baltazar, 194 SCRA 114 ). This is so because a public document duly executed and entered in the proper registry is presumed to be valid and genuine until the contrary is shown by clear and convincing proof (Asido vs. Guzman, 57 Phil. 652 ; U.S. vs. Enriquez, 1 Phil 241 ; Favor vs. Court of Appeals, 194 SCRA 308 ). As such, the party challenging the recital of the document must prove his claim with clear and convincing evidence (Diaz vs. Court of Appeals, 145 SCRA 346 ). The factual backgrounds of the two cases are so different and unrelated that the Dy case cannot be used to prove specific intent, knowledge, identity, plan, system, scheme, habit, custom or usage on the part of petitioner Citibank or its officer, Mr. Tan, to defraud respondent in the present case. This Court disagrees in the pronouncement made by the Court of Appeals summarily dismissing the documentary evidence submitted by petitioners based on its broad and indiscriminate application of the best evidence rule.

The Statute of Frauds; purpose; rules

Hence, I will address the argument from the viewpoint of res judicata. Section 9 – The proposition in an initiative on the Constitution approved by a majority of the votes cast in the plebiscite shall become effective as to the day of the plebiscite. None of the foregoing standards is present in the issues raised before this Court. What is at stake here is the legality and not the wisdom of the act complained of. This completes the blanks appearing in the original Committee Report No. 7.

  • Justices cannot abandon their constitutional duties just because their action may start, if not precipitate, a crisis.
  • Article 8, New Civil Code provides that “udicial decisions applying or interpreting the laws or the Constitution shall form part of the legal system of the Philippines.”
  • It is elementary that when there is conflict between the dispositive portion or fallo of the decision and the opinion of the court contained in the text or body of the judgment, the former prevails over the latter.
  • In which case, if the offeror does not perform his obligations under the perfected contract, he shall be liable for all consequences arising from the breach thereof based on any of the available remedies such as specific performance, or rescission with damages in both cases.

With Federico Elizalde as chairman, the members of the committee are Public Works Secretary Florencio Moreno, Director of Planning Anselmo T. Alquinto, Foreign Affairs Undersecretary Raul S. Manglapus, National Museum Director Eduardo Quisumbing Juan Nakpil, Eugenio Puyat, and Rev. Fr. PRESIDENT Magsaysay today signed Executive Order No. 157, creating a committee to choose a parcel of vacant government land in Manila as a suitable site for the national theater and to prepare an appropriate architectural design or plan for it. An old settler named Brigido Geronimo told the President that he owned 10 hectares which he was cultivating to cotton under contract with the NDC. Geronimo said that after the harvest he got only P10 per hectare as his share. The President suggested that the contract should be changed in such a way that after the tenant had paid his debts to the NDC, the remaining amount should be given to the landowner as his profit in order that he could improve his living. The President was displeased to know that up to the present time his program to accelerate the production of coffee through the RFC had not been implemented.
